1. Agreement to Terms

By accessing or using Opti's educational platform, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access or use our service.

2. Educational Purpose and Medical Disclaimer

Opti is an educational platform designed exclusively for learning cardiac electrophysiology and ECG interpretation through interactive 3D visualizations, learning modules, and quizzes.

IMPORTANT MEDICAL DISCLAIMER:

  • This platform is NOT intended for clinical diagnosis, patient care, or medical decision-making
  • All ECG patterns, 3D visualizations, and educational content are for learning purposes only
  • Never use this platform as a substitute for professional medical advice, diagnosis, or treatment
  • Always seek the advice of qualified healthcare professionals for medical conditions

3. Platform Features and Services

Opti provides the following educational services:

  • Interactive 3D cardiac electrophysiology visualizations
  • ECG learning modules with synchronized animations
  • Interactive quizzes and educational assessments
  • Progress tracking and learning analytics
  • ECG simulation tools (12-lead and single-lead)
  • Case studies and clinical scenarios

4. User Accounts and Subscriptions

4.1 Account Registration

  • You must provide accurate and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You may not share your account or allow others to use your login credentials
  • You must notify us immediately of any unauthorized use of your account

4.2 Subscription Plans

  • Opti Pro access is available via Monthly or Yearly subscription plans
  • Subscriptions are billed automatically at the start of each billing period (monthly or annually, depending on your plan)
  • The price displayed at checkout is the amount you will be charged each billing period
  • All payments are processed securely through Stripe

4.3 Auto-Renewal

  • Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date
  • By subscribing, you authorize Opti to charge your payment method on a recurring basis until you cancel
  • For annual subscriptions, we will send a reminder email before your renewal date
  • You can view your next billing date in your Account Settings

4.4 Cancellation

  • You may cancel your subscription at any time from your Account Settings or by contacting support at matthew@opti-ecg.com
  • Cancellation takes effect at the end of your current billing period — you will retain Pro access until then
  • To avoid being charged for the next billing period, you must cancel before your renewal date
  • After cancellation, you can resubscribe at any time to regain Pro access

4.5 Price Changes

  • We reserve the right to modify subscription pricing with at least 30 days' advance notice
  • Price changes will apply to your next billing cycle after the notice period
  • You may cancel your subscription before the new price takes effect if you do not wish to pay the updated rate

4.6 Legacy One-Time Purchases

  • Users who purchased Opti Pro via a one-time payment prior to the introduction of subscriptions retain access for the duration specified at purchase
  • One-time purchases are non-recurring and do not auto-renew

5. Intellectual Property Rights

All content, including but not limited to:

  • 3D heart models and anatomical visualizations
  • ECG waveforms, patterns, and educational materials
  • Software, algorithms, and visualization technologies
  • Quizzes, learning modules, and educational assessments
  • Text, graphics, logos, and user interface elements

are owned by Opti or our licensors and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without explicit written permission.

6. Acceptable Use Policy

You agree NOT to:

  • Use the platform for clinical diagnosis or patient care decisions
  • Attempt to reverse engineer, decompile, or extract our algorithms
  • Share, sell, or redistribute your account access
  • Upload malicious code, viruses, or harmful content
  • Interfere with the platform's security features or functionality
  • Use automated tools to scrape or download content
  • Violate any applicable laws or regulations
  • Impersonate others or provide false information

7. Cancellation and Refund Policy

7.1 Subscription Cancellations

  • You may cancel your subscription at any time from your Account Settings
  • Upon cancellation, you will retain Pro access until the end of your current billing period
  • No partial refunds are provided for unused time within a billing period
  • To avoid being charged for the next period, cancel before your renewal date

7.2 Refund Eligibility (Subscriptions)

Subscription payments are generally non-refundable. However, we may issue refunds in the following situations:

  • Technical Issues: Persistent technical problems that prevent access to Pro features after reasonable troubleshooting attempts
  • Billing Errors: Duplicate charges or incorrect billing amounts
  • Unauthorized Transactions: Charges made without your authorization

7.3 Non-Refundable Situations

  • Forgetting to cancel before automatic renewal
  • Partial billing periods after using the service
  • Change of mind after the start of a billing period
  • Access revoked due to Terms of Service violations
  • Requests based on features not explicitly promised

7.4 Legacy One-Time Purchase Refunds

For users who purchased Opti Pro via one-time payment before subscriptions were introduced:

  • 14-Day Satisfaction Guarantee: Full refund within 14 days of purchase if unsatisfied
  • Requests made more than 14 days after purchase are not eligible for refund

7.5 Refund Process

  • Contact matthew@opti-ecg.com with your account email and reason for refund request
  • Approved refunds are processed within 5-10 business days to the original payment method
  • Pro access is revoked upon refund approval

8. Data and Privacy

Your use of Opti is subject to our Privacy Policy, which details how we collect, use, and protect your information through our Supabase database infrastructure. By using our service, you consent to our data practices as described in the Privacy Policy.

9. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE SPECIFICALLY DISCLAIM:

  • Any warranties of merchantability or fitness for a particular purpose
  • Accuracy or completeness of educational content
  • Uninterrupted or error-free service operation
  • Security of data transmission over the internet

3D visualizations and ECG patterns are educational approximations and may not reflect exact physiological conditions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPTI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify and hold harmless Opti from any claims, damages, or expenses arising from your use of the service, violation of these terms, or infringement of any third-party rights.

12. Service Modifications and Termination

We reserve the right to:

  • Modify, suspend, or discontinue any part of the service
  • Update features as outlined in our development roadmap
  • Terminate accounts for violations of these terms
  • Change these terms with 30 days' notice to users

13. Governing Law

These terms are governed by the laws of the jurisdiction where Opti operates. Any disputes will be resolved through binding arbitration or in the appropriate courts of that jurisdiction.
